Les plateformes en ligne facilitent ce proc\u00e9d\u00e9.\n<\/p>\n\n<p>\n  Il convient de distinguer la sous-location dans le parc priv\u00e9 et la sous-location dans le parc\n  social, ces deux r\u00e9gimes \u00e9tant soumis \u00e0 des r\u00e8gles diff\u00e9rentes.\n<\/p>\n\n<p>\n  <a href=\"\/contact\/\">Parler \u00e0 un enqu\u00eateur<\/a>\n  &nbsp;|&nbsp;\n  <a href=\"\/particulier\/\">Nos enqu\u00eates pour particuliers<\/a>\n<\/p>\n\n<hr>\n\n<h2 id=\"parc-social\">Pour le parc social<\/h2>\n\n<p>\n  Un locataire ayant sous-lou\u00e9 ill\u00e9galement son logement social conventionn\u00e9 peut \u00eatre condamn\u00e9\n  au remboursement int\u00e9gral des loyers per\u00e7us. La sous-location d'un logement social, donc \u00e0\n  loyers conventionn\u00e9s, est interdite, sauf dans le cadre de situations sp\u00e9cifiques (personne de\n  plus de 60 ans, accueillant familial, etc.), et sous r\u00e9serve de respecter certaines conditions\n  de loyer et de surface sous-lou\u00e9e.\n<\/p>\n\n<p>Pour que le bailleur obtienne une r\u00e9paration compl\u00e8te, certains principes \u00e9dict\u00e9s par la Cour de cassation doivent \u00eatre respect\u00e9s, comme :<\/p>\n\n<ul>\n  <li>Mettre en demeure le locataire de cesser son activit\u00e9 ;<\/li>\n  <li>Mettre en avant la gravit\u00e9 de la faute du preneur vis-\u00e0-vis des obligations inh\u00e9rentes au logement \u00e0 loyer conventionn\u00e9 ;<\/li>\n  <li>Le changement de destination des locaux par l'utilisation \u00e0 des fins lucratives et r\u00e9p\u00e9t\u00e9es d'une partie du logement.<\/li>\n<\/ul>\n\n<p>Les cons\u00e9quences pour le locataire sont :<\/p>\n\n<ul>\n  <li>Remboursement des loyers ind\u00fbment per\u00e7us par droit d'accession (CC : art. 548 ; Cass. Civ. 3, 12 septembre 2019, n\u00b0 18-20.727) ;<\/li>\n  <li>La r\u00e9siliation de son bail ;<\/li>\n  <li>En cas de d\u00e9gradation, des r\u00e9parations pouvant lui incomber ;<\/li>\n  <li>Une amende pouvant s'\u00e9lever jusqu'\u00e0 9 000 \u20ac.<\/li>\n<\/ul>\n\n<h2 id=\"parc-prive\">Pour le parc priv\u00e9<\/h2>\n\n<p>\n  L'article L145-31 du Code de commerce dispose : \u00ab Sauf stipulation contraire au bail ou accord\n  du bailleur, toute sous-location totale ou partielle est interdite. \u00bb\n<\/p>\n\n<p>Le second alin\u00e9a de cet article pr\u00e9cise : \u00ab En cas de sous-location autoris\u00e9e, le propri\u00e9taire est appel\u00e9 \u00e0 concourir \u00e0 l'acte. \u00bb<\/p>\n\n<p>\n  La sous-location autoris\u00e9e est donc une op\u00e9ration \u00e0 3 parties. L'accord de sous-location et\n  l'accord sur les montants de loyer sont obligatoires, et ce m\u00eame pour les sous-locations de\n  tr\u00e8s courte dur\u00e9e.
